Terms and Conditions of Sale

Last updated: September 2026

These General Terms and Conditions of Sale apply to all orders placed on the website studiotadaima.com.

1. Seller

The site is operated by:

Tadaima

Manou Boualam
Individual entrepreneur – micro-enterprise
SIREN: 877 592 774
21 esplanade de l'Europe
34000 Montpellier, France
Email: contact@studiotadaima.com

VAT not applicable, in accordance with article 293 B of the French General Tax Code.

2. Products

Tadaima offers a selection of Japanese ceramics, tea utensils, as well as teas and other products associated with Japanese tea culture.

Products are presented with their essential characteristics, their price and, where relevant, their dimensions, capacity, and manufacturing particularities.

Handcrafted pieces may show slight variations in shape, color, texture, or glaze. These variations, when resulting from the handcrafted nature of the manufacturing, do not constitute defects.

Photographs are taken with care to represent the products as faithfully as possible. However, slight differences may exist between the photographs and the actual product, particularly due to lighting and display conditions.

3. Availability

Products are offered subject to stock availability.

When a piece is unique, its availability is indicated on its product sheet.

In the event of exceptional unavailability of a product after an order has been validated, Tadaima will inform the customer as soon as possible and will, if necessary, refund the corresponding amounts.

4. Prices

Prices are indicated in euros.

Tadaima benefits from a VAT exemption. Therefore, VAT is not applicable, in accordance with article 293 B of the French General Tax Code.

Delivery costs are indicated before the final validation of the order.

Tadaima reserves the right to modify its prices at any time. Products are invoiced based on the price displayed at the time of order validation.

5. Order

The customer selects the products they wish to order and adds them to their cart.

Before validating the order, the customer can check its content, its total price, as well as any delivery costs, and correct any potential errors.

Validation of the order implies acceptance of these General Terms and Conditions of Sale and the obligation to pay.

The order is definitively registered after payment confirmation.

An order confirmation is sent to the customer electronically.

6. Payment

Payment is made at the time of order using the payment methods offered on the site.

The order is prepared after payment confirmation.

In the event of a refused payment or an unsuccessful transaction, the order cannot be shipped.

7. Delivery

Orders are shipped to the address indicated by the customer when placing the order.

Applicable destinations, methods, costs, and delivery times are indicated before the order is validated.

Unless otherwise indicated, the order is delivered within the time specified when placing the order and, in the absence of an indication, no later than thirty days following the conclusion of the contract.

In the event of a delivery delay under the conditions provided by regulations, the customer has the rights provided by the French Consumer Code.

8. Receipt and Damaged Products

Ceramics are fragile items and are carefully packaged before shipment.

Upon receipt, we recommend that the customer check the condition of the package and its contents.

If an item arrives damaged, the customer is invited to contact Tadaima as soon as possible at contact@studiotadaima.com, indicating:

  • their order number;
  • photographs of the damaged item;
  • photographs of the outer packaging;
  • photographs of the inner packaging.

These elements allow Tadaima to quickly address the situation with the customer and, if necessary, with the carrier.

The request for photographs does not limit the consumer's rights under legal guarantees.

9. Right of Withdrawal

In accordance with the regulations applicable to distance selling, the consumer has a period of fourteen days to exercise their right of withdrawal, without having to justify their decision or incur any penalty.

For goods, this period runs from the day after the product is received by the consumer or by a third party designated by them.

The customer can exercise their right of withdrawal by sending Tadaima a clear statement expressing their wish to withdraw or by using the standard withdrawal form attached to these General Terms and Conditions of Sale.

For online orders, Tadaima also provides a feature allowing the right of withdrawal to be exercised directly and free of charge online, in accordance with current regulations.

The customer then has fourteen days from the communication of their decision to withdraw to return the products concerned.

Products must be returned carefully and, where possible, in their original packaging.

10. Return Costs

In the event of exercising the right of withdrawal, the direct return costs are borne by the customer.

This provision does not apply when the returned product is defective or not in conformity with the order.

11. Refund

In the event of exercising the right of withdrawal, Tadaima will refund the sums paid by the customer, including initial standard delivery costs.

The refund is made via the same payment method as that used during the order, unless otherwise agreed with the customer.

Tadaima may defer the refund until the products are recovered or until receipt of proof of their shipment, the date of the first of these events being taken as the effective date.

Additional costs corresponding to the choice of a more expensive delivery method than the standard delivery method are not refunded.

12. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to products for which regulations provide an exception.

This may particularly concern certain food products when their nature does not allow their reshipment or when they are likely to deteriorate or expire quickly.

When an exception to the right of withdrawal applies to a product, this is indicated on its product sheet before ordering.

13. Legal Guarantees

Products sold by Tadaima benefit from applicable legal guarantees, notably the legal guarantee of conformity and the legal guarantee against hidden defects.

The legal guarantee of conformity applies under the conditions provided by articles L.217-3 et seq. of the French Consumer Code.

The consumer has, in particular, a period of two years from the delivery of the goods to act under the legal guarantee of conformity, under the conditions provided by regulations.

These guarantees apply independently of the right of withdrawal.

14. Complaints

For any questions or complaints regarding an order, a product, or its delivery, the customer can contact Tadaima:

contact@studiotadaima.com

Tadaima strives to process each request as quickly as possible.

15. Consumer Mediation

In the event of a dispute, the customer must first send a written complaint to Tadaima to seek an amicable solution.

After having made a prior complaint to Tadaima and in the absence of an amicable resolution, the consumer can, free of charge, refer the matter to the consumer mediator with whom Tadaima is affiliated.

Consumer Mediator:

Centre de la Médiation de la Consommation des Conciliateurs de Justice (CM2C)

[Mediator's contact details to be completed after adhesion]

16. Applicable Law

These General Terms and Conditions of Sale are subject to French law.
